Basic Swimming Pool Rules and Regulations
Claybrooke Homeowners Association ("CHA")

I. INTRODUCTION

The safety, health and comfort of all members is the basic objective of the following rules and regulations ("Regulations") with respect to the ClayBrooke pool and pool area (the area inside the pool fence and the pool house and surrounding common area), as formulated by the CHA Board of Directors ("board") and Pool Committee. It is the duty and responsibility of all members, their children, and guests, to adhere to and encourage compliance with these Regulations.

The Board and Pool Committee welcome your suggestions regarding any phase of pool operations.

II. 2010 POOL SEASON

The pool is now open for the 2010 season. Please be sure to read this page completely for rules and regulations when using the pool, and keep in ming to be courteous to your fellow neighbors.

III. HOURS OF OPERATION

Pool hours will be 7 am until 9 pm daily all seven days. Pool hours may be shortened or extended from time to time at the discretion of the Board. Hours are subject to change without notice. NO ONE WILL BE PERMITTED IN THE POOL AREA AT ANY TIME OTHER THAN THE POOL HOURS OF OPERATION. The pool may not be closed for private parties to the exclusion of CHA members at any time.

IV. POOL USE

  1. Diving is not permitted because of the shallow depth of the pool.
  2. Persons (including members and guests) under the age of 14 must be accompanied by a parent, legal guardian or other adult at all times while in the pool area. Members under age 18 will be limited to two guests if not accompanied by parent or legal guardian (See Guest Policy).

V. POOL ACCESS AND GUEST POLICY

A. Keys. Each CHA pool member family shall be issued 2 pool keys. The Pool Committee is currently researching the feasibility of a card entry system. Replacement keys will be provided by CHA for a fee. Pool keys are otherwise not to be duplicated. The pool must be locked at all times (including during hours of operation) when not in use. Any family delinquent in property owner dues shall have all pool privileges revoked until said dues are paid in full.

B. Guest Policy

  1. Except as specifically set forth below, all guests must be accompanied by an inviting CHA member at all times while in the pool area.
  2. All parties, events and other functions including ten (10) or more guests are subject to registration with the Pool Committee and to the prior approval of the Board in its sole discretion.
  3. "Out of Town Guests" may use the pool without being accompanied by a CHA member, provided the inviting CHA family member registers each out of town guest with the Pool Committee (name, address, length of stay, and other data as required by the Board) and secures a Guest Pass from the Pool Committee. Guest Passes must be openly displayed by guests requiring Guest Passes at all times while in the pool area. Each CHA member family may be issued no more than five (5) Guest Passes at any given time (Out of Town and other guests accompanied by a CHA member do not need Guest Passes). An Out of Town Guest means any person who resides outside of Mecklenburg County, North Carolina and contiguous counties and who spends at least one (1) but no more than fourteen (14) consecutive overnight visits with a CHA member family. Guest Passes for Out of Town Guests may be extended for longer periods at the discretion of the Pool Committee.
  4. Each CHA member family is responsible for the safety, actions and behavior of its respective Out of Town Guests and all other guests, including without limitation the compliance with all Regulations and responsibility for all property damage. It is the responsibility of each inviting member to carefully review these Regulations with their guests.
  5. Children under 14 years of age may not bring a guest without being accompanied by an adult.
  6. Members under age 18 will be limited to two (2) guests if not accompanied by a parent or legal guardian.
  7. In any event, guests may only use the pool only in compliance with the above Regulations and only when such use does not interfere with the quiet and peaceful use by other members.
  8. The Board and Pool Committee reserve the right to limit guests as pool demand increases.

VI. POOL EQUIPMENT PRESERVATION

Under no circumstances is any person to play with cleaning implements. Pool furniture may not be removed from the pool area at any time.  Pool furniture may not be placed in the pool. Each member is responsible for the actions of his family and guests and will be charged for any damaged property. No unauthorized person will be allowed in the filter room at any time. Under no circumstances are the drain lids to be removed from the bottom of the pool. No person is to play with the pool cleaning equipment, life ring, or other apparatus. The cost of any property damage due to negligence or abuse will be charged to the responsible member.

VII. PERSONAL PROPERTY

The CHA is not responsible for loss or damage to personal property. No personal property may be maintained or stored in the pool area without the prior express written consent of the Board.

VIII. SAFETY

  1. NO GLASS of any kind is permitted within the pool area. No running, pushing, wrestling or horseplay that is unsafe or disturbs the enjoyment of the pool facilities will be permitted.
  2. No extension cords of any kind shall be used in the pool area.
  3. The pool must be evacuated if lightning is seen or thunder is heard. Swimming may resume if weather conditions are clear for 20 minutes.
  4. No food, drinks, or gum is allowed in the pool. This constitutes a health hazard as well as interferes with the drainage and pump equipment.

IX CLEANLINESS

  1. All trash that creates or furthers overflow of available containers must be removed by the responsible member. All trash must be disposed of and the pool area must be left clean and neat.
  2. Members should encourage their children to use the bathroom facilities provided at the pool area. Trash must be deposited in the trash receptacles. No rocks, debris, chewing gum or spitting will be allowed in the pool or pool area. Bathing suits are the only acceptable attire. No person will be allowed in the pool while wearing any street clothes. Showering before entering the pool is required.
  3. NO DISPOSABLE DIAPERS ARE ALLOWED IN THE POOL. Swim diapers and/or rubber pants will be required. PARENTS, PLEASE PAY SPECIAL ATTENTION TO THIS POOL RULE. THE MECKLENBURG COUNTY HEALTH DEPARTMENT ADVISES THAT SHOULD A 'DIAPER ACCIDENT' OCCUR, THEN THE POOL MUST BE CLOSED A MINIMUM OF SIX HOURS FOR CLEANING, CHLORINATION, ETC... In such event, or any other contamination event (ex. vomiting, nose bleeds, etc.), the Pool Management Company must be notified immediately.

X. PETS

No pets are allowed inside the pool area, or tied to the pool fence.

XI HEALTH

The pool may not be used by any person having or appearing to have any infectious diseases, excessive sunburn, open sores, bandages, inflamed eyes, colds, nasal or ear discharge as well as any ailments which could adversely affect water cleanliness and/or endanger the well being of others.

XII. SMOKING

Smoking is not allowed in the pool area.

XIII. PERSONAL CONDUCT

  1. With due regard to the close proximity of homes to the pool area as well as respect for other pool users, the noise level must be kept at a minimum. Battery operated radios, televisions, tapes and CD players are permitted at a reasonable volume so as to not disturb other pool users.
  2. No running, horseplay, splashing and/or boisterous conduct or inappropriate language shall be permitted in or around the pool area.

XIV. TELEPHONE

Pool telephone can only be used for local calls. Calls should be limited to three minutes.

XV. ENFORCEMENT AND PENALTIES

Infractions of these Regulations shall be reported to any Pool Committee or Board member for enforcement. Enforcement may include suspension of all pool privileges. The failure by any CHA member, including any Board or Pool Committee Member, to enforce these Regulations shall not be construed in any manner as a waiver of all or part of such Regulations. The requirements set forth in these Regulations may only be waived in writing by the Board.

XVI. POSTED REGULATIONS

All CHA members and guests are also subject to and shall abide by the rules and warnings posted in and around the pool area.

XVII. RELEASE AND INDEMNIFICATION

Members and guests agree to release, indemnify and save harmless the CHA and its Board from any and all damages, liabilities and actions whatsoever or by any member or guest related to the use of the swimming pool area.

XVIII. NO ASSUMPTION OF LIABILITY

Any registration with the Pool Committee or approval of the Board required anywhere in this document is for information and enforcement purposes only and shall not and should not in any manner be construed as the assumption by the Pool Committee, CHA or its Board or any officer thereof of any obligation, responsibility or liability related to such events or guests.

XIX. AMENDMENTS

The Board reserves the right to change, delete, and/or add to these Regulations as the need arises.
