EXPUNGEMENT IN NC

Expungement in NC is limited to mainly offenses that occurred when you were a minor. Expungement can be done in some circumstances over age 18 but look at the guidelines for expungement on the web. Click here  to see an article from NCSU that discusses it.

You may already know that expungement cannot be done if you committed a felony at age 21. Even if you stole a bail of hay, or stole a rooster. However there is a bill in the NC Legislature that would change this lifetime barrier. Senate Bill 491, Expunge Non Violent Crimes can be viewed by clicking here. This bill, if passed into law, will allow some non violent offenses, to become expunged after 10 years. If you are for second chances, please write your local law makers. You can make a difference.

However I fear this bill is being 'slow walked' because several large lobby groups are lobbying against this second chance bill. There are some that feel this bill is, soft on crime. The bill has been stuck in the finance committee since May 2009. One group that was against this bill was the NC Sheriff's Association. However last year they changed their position to neutral. Click here. Another group against this bill is the NC FOP. I received a copy of an email from the president here. I have written these groups asking them to change their position. One of them I used to send money to every year, until I found out they were holding me back. Consider donating money and time to groups that favor re-entry activities.
