I James Kenney of the State and County aforesaid being in bad health but of perfect mind and memory recommend my soul in to the hands of almighty God _____ ________worldly estate wherein it hath pleased God to bless me with in this life. I give demise and dispose of the Same in the following manner and form to wit. I give to my dearly loved wife Sarah Kinney the plantation where I now live and one forty (40) acre lot of land in Lumpkin County together with the Stock of all kinds and three negroes (to wit) Lucy a woman Rhody a woman and Monah a girl and all my money and notes during her lifetime and at her death two hundred and fifty (250) acres of the above named tract of land together with the improvements therein is to belong to my daughter Martha Jackson the balance of the tract of land is to belong to my son Charles Kinney. I also give to my son Charles Kinney five hundred dollars in money in lieu of a negro. To my grand Daughter Nancy E. Williamson, I give one hundred dollars money, ninety dollars of which sum she has already received. to my granddaughter Sophia Kinney I give twenty five dollars of money.
It is my will that one forty (40) acre lot of land in Lumpkin County and the third of a tract ___ on the Chestatee River at Martins ford together with the Stock and the above named three negroes and their increase is to be equally divided among my four Children: Sarah Wills, Joseph A. Kinney, Charles Kinney and Martha Jackson at the death of My wife Sarah Kinney.
I make and ordain this my last will and testament.
I also appoint my wife Sarah Kinney and Joseph A. Kinney and John S. Jackson my lawful Executors.

Personally appeared in open Court Robert Fowler, Charles Lavender and Joseph Bell the Subscribing witnesses to the within and foregoing will of James Kinney late of said County Deceased, made an oath depose and say that they saw said deceased sign and seal said instrument and heard him acknowledge the same to be his last will and testament that at the time of his doing he was of sound and disposing mind and memory that they each subscribed the same as witnesses in the presence of the testator and of each other.
