Last Will & Testament of Mrs. E. C. McDaniel
I, Mrs. E. C. McDaniel of said county and state being of sound and disposing mind and memory, do make this my last will and testament, hereby revoking all wills heretofore made by me.
Item # 1
I will and direct that all my just debts be paid should I leave any unpaid at the date of my death.
Item # 2
I will and direct that all my household things be equally divided between all my children if they can agree on a division among themselves and if they cannot agree on a division of all said household things, then and in that event the household things to be sold that they cannot divide.
Item # 3
My son Robert C. McDaniel owes me a note given for borrowed money for $500.00 dated Feb. 1, 1921. I notice this note was drawn to draw interest from maturity when it should have been from date. I will and direct that this $500.00 with interest from Feb. 1, 1921 be charged against my said son Robert C. McDaniel in the division of my estate unless he pays it before my death, or such part as remains unpaid at my death.
Item # 4
My son Charlie P. McDaniel owes me four notes for $500.00 each and one note for $160.00 making a total of $2160.00 with interest at 8% from Feb. 3, 1921 all said notes given for borrowed money. He also owes me another note for $40.00, dated April 7th 1920 drawing interest from it's date at 8%. He also owes me an account of $75.00 for borrowed money which I let him have several years ago in the year 1911. The $2160.00 is secured by a deed to certain property in DeKalb County, Georgia, as fully described in a deed made by him to me dated January 28, 1921 and recorded in record of deeds book 42 page 268; Clerks office, DeKalb County, GA on Feb. 6, 1922. I feel that under present conditions this property does not fully secure said indebtedness, and I will and direct that whatever remains unpaid on any of said indebtedness at my death by charged against my said son Charlie P. McDaniel in the division of my estate. If said land is sold either before or after my death and the proceeds thereof credited on siad indebtedness the balance remaining unpaid shall be charged against my said son Charlie P. McDaniel in the division of my estate.
Item # 5
I will and direct that all my property both real and personal be equally divided among my children to wit: Mrs. Miranda Ewing; Mrs. Lillie Garner; James L. McDaniel; John E. McDaniel; William C. McDaniel; Charlie P. McDaniel; Thomas W. McDaniel and Robert C. McDaniel (Robert C. McDaniel and Charlie P. Mc Daniel to first be charged with and account for the indebtedness due by each of them to me at my death and set forth in Item 3 & 4 of this my last will and testament. The purpose of this will is to make each and all my children equal in the division of my estate & this is why I have charged Robert C. McDaniel and Charlie P. McDaniel with what they owe me for money already obtained so if any part of it is not paid with interest before my death whatever is due most first be deducted from what would be going to either of them so as to make all the other children equal in the division of my estate as far as possible.
Item # 6
My farm in Newton County and house and lot in Atlanta, GA will have to be sold so as to divide my estate, and I will and direct that my executors hereinafter named shall have the right to sell said property at either public or private sale and without the order of any court.
Item # 7
I nominate and appoint my two sons James L. McDaniel and Thos. W. McDaniel as executors of this my last will and testament.

A retired contractor, McDaniel was born in Gwinnett County and came to Anthony from Nashville, Tenn. 18 years ago. He was a member of Anthony Baptist Church. . . Survivors include his wife, Mrs. Lois T. McDaniel, Anthony; daughters, Mrs. Ava B. Frakes, Pensacola; Mrs. Dorothy C. Holmes, Mrs. Barbara M. Spurlock, both of Miami; 10 grandchildren; 11 great-grandchildren.
