Will of T. A. EVANS
Georgia, Jackson County.
I, T. A. Evans of said State and County, being of sound and disposing mind and memory, do make this my last will and testament, hereby revoking and annulling all others, by me heretofore made.
1. Desire and direct that my body be buried in a descent and Christian-like manner, suitable to my circumstances and condition in life.
2. I desire and direct that all my just debts by paid without unnecessary delay, by my executors hereinafter named and appointed.
3. I give, bequeath and devise to my daughter, Maude Evans, the sum of two hundred dollars.
4. I give and bequeath to my six living children, namely, Mrs. W. H. Maley, Miss Maude Evans, Mrs. F. T. Richey, Mrs. Hoyt Nunn, A. E. Evans, and F. W. Evans all of the residue of my estate, both real and personal of every sort soever not hereinbefore specially devised, in equal shares, share and share alike. (My three grandchildren, namely, Howell Garrison, Mrs. Hoyt Merk, and Mrs. Claude Merk are not to receive any of my estate as provision for them have or will be made during my life time.).
5. I hereby constitute and appoint my son, A. E. Evans, and my son-in-law, W. H. Maley executors of this my will and testament, and I expressly confer upon them power, as such, to administer my estate, excusing them from giving and bond, or making any returns to the Ordinary and I expressly confer upon them the full authority and power to sell any part of my extate at public or private sale, with or without notice as they may deem best, and without any order of Court, making good and sufficient conveyances to the purchaser and holding the proceeds of the said sale to the same uses and trusts as hereinbefore declared in the several items of this my will.
I futher hereby expressly confer upon them the authorith and power to receive out of my estate 5% of all money handled by them in the discharge of their duties as executors of this my will and testament. This 25, day of March, 1937.
